These Terms of Service (Terms) govern your access to and use of the online services provided by Mapka P.S.A ('Mapka', 'we', 'us', 'our'), including:
- the Mapka website at mapka.dev and any subdomains,
- the Mapka web application and dashboard (the 'App'), and
- any APIs, SDKs, tools, and related services (together, the 'Service').
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Mapka P.S.A is a company established under the laws of Poland.
2. Eligibility and accounts
You may use the Service only if you:
- are at least 18 years old (or the age of legal majority in your jurisdiction), and
- have the legal capacity to enter into a binding contract.
If you create an account:
- You must provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your login credentials and any API keys.
- You are responsible for all activity occurring under your account or using your API keys.
If you use the Service on behalf of a company or other legal entity, you represent and warrant that you are authorised to bind that entity to these Terms.
3. Description of the Service
Mapka provides a developer-focused platform for mapping and geospatial workloads, which may include:
- map rendering, map loads and tile APIs,
- custom maps and tilesets,
- data storage and processing,
- AI-powered processing (e.g. token-based AI input/output and processing time), and
- dashboards, usage metrics and related developer tools.
Important limitations
The Service is not designed for safety-critical or life-critical use (e.g. aviation, maritime navigation, emergency response, medical, or nuclear), or uses where inaccurate or unavailable data could lead to death, personal injury, or significant property or environmental damage.
4. Your use of the Service
4.1 Acceptable use
You agree that you will not, and will not allow others to:
Prohibited: Use the Service in any way that violates applicable law, infringes intellectual property rights, or is fraudulent, misleading, harmful, or defamatory.
Prohibited: Interfere with or disrupt the Service, including bypassing security measures, vulnerability scanning, or imposing unreasonable load on infrastructure.
Prohibited: Reverse engineer, decompile, or derive source code of any part of the Service, except as allowed by mandatory law.
Prohibited: Use the Service to create a competing service, bulk-download data beyond what is allowed, or circumvent usage-based pricing.
4.2 APIs, usage metrics, and limits
Usage is measured in various metrics, including:
We may throttle, limit, suspend, or terminate access if you exceed quotas, your usage appears abnormal, or we suspect abuse.
5. Free tier, pricing and billing
5.1 Free tier
- Fixed monthly quotas for several usage metrics
- No credit card required
- Usage pauses when quota is reached
5.2 Usage-based pricing
- Pay only for usage beyond free quotas
- Rates published on Pricing page
- Automatic billing when you add a card
5.3 Payment and invoicing
- Usage fees charged in arrears (monthly)
- Add-on fees may be charged in advance
- You must keep billing info accurate
5.4 Taxes
- Fees are exclusive of taxes (VAT, etc.)
- You are responsible for applicable taxes
5.5 Changes to pricing, quotas and plans
We may update pricing with reasonable notice. Changes apply from the next billing period. Continued use means acceptance.
5.6 Add-ons
Optional add-ons include:
- • 'No Mapka attribution' – remove Mapka logo from maps
- • 'Basic support' – priority email support
- • 'Business Premium Support' – enhanced SLA-backed support
5.7 No refunds
Unless required by law, fees are non-refundable. Partial months or unused quotas are not refunded.
6. Intellectual property and attribution
The Service, including software, code, APIs, SDKs, designs, text, graphics, and all related IP rights, is owned by or licensed to Mapka and its licensors.
License granted to you:
A limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service and integrate our APIs/SDKs into your applications, solely as described in our documentation.
Without attribution add-on: You must not remove or modify the Mapka logo or attribution. Keep third-party attributions visible.
With attribution add-on: You may remove Mapka branding, but must still comply with third-party data provider attribution requirements.
7. Third-party services and data
The Service may incorporate or rely on map data, imagery, tiles, APIs, and other content from third-party providers, including:
- • Third-Party Data Providers are independent of Mapka and not controlled by us.
- • You must comply with applicable terms of Third-Party Data Providers when using their data.
- • Mapka is not responsible for accuracy, completeness, or availability of third-party data.
8. Your data and privacy
You may submit or upload content, configuration, datasets, or other materials to the Service ('Your Data').
You represent and warrant that:
- • You have all necessary rights and permissions to use and process Your Data
- • Your Data complies with applicable law and does not infringe third-party rights
You grant Mapka a licence to host, store, process, transmit, and display Your Data as necessary to provide the Service, and to generate aggregated or anonymised statistics.
Our processing of personal data is described in our Privacy Policy.
9. Service availability and support
Mapka aims to provide the Service with reasonable care and skill, but we do not guarantee the Service will be always available or free from errors. Downtime may occur due to maintenance, updates, or factors outside our control.
Different levels of support (Basic, Business Premium) may be available as add-ons with specific SLAs.
You are responsible for:
- • Maintaining compatible hardware, software, and network connections
- • Implementing appropriate backups and safeguards for Your Data
10. Disclaimer of warranties
To the maximum extent permitted by applicable law:
- • The Service is provided 'as is' and 'as available', without any express or implied warranties.
- • Mapka does not warrant that the Service will be uninterrupted, secure, or error-free.
- • Maps, tiles, geospatial data, AI outputs, or other information may not be accurate, complete, or up to date.
- • You are responsible for evaluating whether the Service is suitable for your intended use.
11. Limitation of liability
To the maximum extent permitted by applicable law:
Mapka shall not be liable for:
- • Loss of profits, revenue, or business
- • Loss of data or corruption of data
- • Loss of goodwill or reputation
- • Business interruption
- • Indirect, incidental, special, consequential, or punitive damages
Maximum liability:
The greater of: total fees paid in the 12 months before the claim, or EUR 100 (for free tier users).
12. Indemnification
You agree to indemnify, defend, and hold harmless Mapka from claims, damages, losses, and expenses arising from:
- 1 Your use of the Service in violation of these Terms or applicable law
- 2 Your Data, including allegations that it infringes third-party rights
- 3 Your breach of third-party terms applicable to data or services accessed through Mapka
13. Term and termination
You may:
Stop using the Service at any time. Close your account through the App or by contacting us.
Mapka may suspend or terminate if:
- • You breach these Terms
- • Your use creates a security risk
- • Required by law or authority
Upon termination:
- • Your access will immediately cease
- • We may delete or anonymise Your Data per our retention policies
- • Accrued fees remain payable
14. Changes to the Service and these Terms
We may modify, update, or discontinue parts of the Service from time to time, for example to improve functionality, address security issues, or comply with legal requirements.
We may also update these Terms. Material changes will be communicated via website, app, or email. Continued use means acceptance.
If you do not agree to updated Terms, stop using the Service and close your account before changes take effect.
15. Governing law and dispute resolution
- Governing law: Laws of Poland (excluding conflict-of-law rules)
- Jurisdiction: Competent courts in Warsaw, Poland
